Ingestion of Hexavalent Chromium No Longer Exempt Under Proposition 65

The California Office of Health Hazard Assessment (“OEHHA”) has removed the exemption under Proposition 65 for exposure to hexavalent chromium via ingestion.  The agency based its decision “on currently available scientific information that shows oral exposures to hexavalent chromium can pose a significant cancer risk.”  The amendment became effective on November 9, 2012.  Products that contain hexavalent chromium, as well as discharges of hexavalent chromium to the environment, may become the focus of Proposition 65 lawsuits.
